except last week we had the very, very unexpected admission by the Trump administration in litigation around that, that like they had made a mistake. They had shipped somebody off who absolutely had an order, right, that said he cannot be sent from 2019. He cannot be sent back to El Salvador. And they said that was a mistake. We made a mistake. They called it, right? They called it an administrative error, which was supposed to be like, oh, like not, you know, returning your library books. But this turns into, I think you're right, the single most important embodiment of what But it is to assert the power to scoop somebody up on the street who has no criminal record, not in this country or any other country, who is married to an American citizen, the father of a U.S. citizen child with autism, to administratively err by sending him right to a supermax brutal, brutal prison in El Salvador to then concede in a courtroom. We made a mistake. And also, we have no intention of doing anything about it. And you can't make us. And that's where we are. And I think you're exactly right. And maybe the other thing, just the gloss worth adding, because obviously this is moving through the courts at lightning speed, but that the president was really quick to say on television this past Sunday that he thinks that, you know, these these black sites should be available for citizens as well. So to the extent that people make the category error, which is this is just, you know, a guy who's not from here and who doesn't have citizenship. It is very, very clear based on how this case proceeded. This could be the judge in that case. This could be the judge on the Fourth Circuit who just heard that case. This could be a justice on the Supreme Court. And he has no, as you say, no recourse. And the administration says we have no intention of fixing it.

Yeah, well, I mean, you know, there's a paradox because although we seem to be at a low point in the modern history of the law in the United States and our justice system, there are only slippery slopes that lead down from where we are. Right. And, you know, each one of these things leads to another slippery slope. You know, the DEI campaign is not about DEI, although it is about racism. It's about the ability to censor a university or censor a law firm or censor speech within the administration. The pressuring law firms is not about one particular person or one particular act. It's about the government having the ability to say, if you take a stand against us, we can punish you using all the tools of the U.S. government. Stopping people at the border with visas initially seemed to be, well, we want to keep criminals out of the United States. But now we've already in months, weeks, days gotten to the point where it's like, oh, well, if there's something bad about Trump on your phone, you're not coming into the United States anymore, which then connects to this issue of who do we round up? in which there were sort of several elements of the decision, one of which people sort of cling to. Well, there has to be due process for these people. I'm going to get to that second. But the other of which is kind of nodding acceptance of the idea that the administration can take an 18th century law designed for wartime, designed to target enemy aliens, and apply it whenever it wants, without any justification, in this case pertaining to Venezuela with whom we are not at war, and a gang who are not enemy combatants in any way, and say, yeah, we can essentially rendition these people to a third country, which, again, not being addressed in this. And that, to me, again, is one of these slippery slopes. And if you're out there and you're going, this is only going to happen to bad guys, and every once in a while there'll be a mistake, although 60 minutes at perhaps 75% of the cases are a mistake, unjustifiable. You're missing the point. The point is they're testing how they can use the system to go after anybody at their own whim. Or am I overstating that? I

don't think you're overstating it. And I think, you know, the level of credulity that the per curium, right, this is a five to four decision. It's an emergency, right? All of these things are on the shadow docket, the emergency docket. So they're neither fully briefed nor argued, right? this is an ongoing problem we had from the first Trump era, which is they had filed at the Supreme Court even, right, they keep doing this thing where they keep filing even before and in the Abrego Garcia decision, which the court just stayed last night. They didn't, this wasn't that. But already we had the Trump administration appealing up to the Supreme Court even before we had a Fourth Circuit decision in that case. So everything's an emergency. Everything goes right to SCOTUS. And then, as you say, the level of kind of perfect credulity, and this is really laid out in Justice Sotomayor's dissent, it's a 5-4 per curiam, the level of, okay, sure, they round up these people, they move them from place to place by design so that nobody knows where they are. They stick them on planes before, right? Anybody knows there's going to be this invocation of the Alien Enemies Act. And they're already in the air, right? When the judge is like, hey, what's going on? Turn the planes around. The level of sort of nested bad faith, David, that was done in order to evade any kind of judicial process or judicial review, utterly invisible in the majority opinion. You would think that this is just like everything they did was right and fair. It's just a question of who has jurisdiction, you know, and they don't have jurisdiction under one law, but they still can bring habeas claims.
