A lot of it comes down to a question about whose speech you are mostly concerned about, I think. People who would say things that are completely protected by the first amendment might be chilled from saying them because they're not sure now if it might be interpreted as a threat. And so the argument is that that's really scary and we have to err on the side of not letting that happen. But there's no evidence that there really is a chilling effect in that sense," he says.
