This would essentially overrule bowling versus sharp and all of those decisions that essentially read an implied equal protection guarantee into the fifth amendment's due process clause. If there are no equal protection principles that bind the federal government, then what is to stop the federal government from inturning alln citizens on the basis of rarace, shatter alienasly, illegitimacy, all t things?
