The Importance of Originalism

Jeffrey Toobin: Most Supreme Court justices engage in some form of originalism. He says the court is trying to determine proper men's rea or mental state requirement when it comes to true threats. In countermen versus Colorado, Justice Kagan wrote an opinion saying historically true threats were banned; Sotomayor said recklessness was appropriate standard. Toobin: Originalism isn't just a so-called conservative, interpretive tool anymore.
