Is There a Requirement for Regulation?
There's lots of creative energy now in the regulatory environment to say, let us do something. Regulation here takes a lot of time because we're dealing with at least five agencies,. none of whom have any primary authority. It's unsurprising that there hasn't been that much rulemaking as every single rule requires a new rule. There were still gaps and there are still gaps in this market for broker dealers who aren't registered HFTs.
