Hermes Metabircan - What Does Hermes Have to Prove?
The Lanamact is the name of the trademark law in the United States. It prohibits anyone from causing confusion or deceit as to affiliation, connection or association. Hermes must prove that consumers would confuse its new Metabircan with Rames' flagship bag. The Rogers-Vigromaldi test could be a defense even if there was consumer confusion.
