Paul Butler: If I could divert it, where charges weren't filed and they went through a class, whether it be a victim impact panel or went to counseling, then that is considered non-prosecuting. John Donvan: But if you lock up people for petty crimes, the evidence, the data suggests that's crimogenic. It makes those folks more likely to commit crimes.
