West Virginia vs EPA - The Major Question Doctrine
The case involved Obama's Clean Power Plan, which was designed to cut carbon emissions by forcing utilities to shift away from using fossil fuels. Chief Justice Roberts said that the case involved a major question, and he pointed to four factors. The first factor is the great economic and political significance of the power claim by EPA. And the court viewed this as the power claiming a power to eliminate coal as a source of fossil fuels.
