The Lanham Act Prohibites False Commercial Speech

The Lanham Act prohibits false commercial speech. In order for this to be a violation of the law, the speech has to be factual in nature. A three judge panel on appeal said that these statements are falsifiable and therefore the litigation can continue. The majority opinion basically is saying, we should seed our claimed expertise over to cybersecurity firms.
