There's this grand bargain of the original constitution in 17 89. A lot of people said, we're not going to ratify this unless there's a bill of right. So they shove in this ninth amendment that says just because we've written down certain rights doesn't mean that this is an exhaustive list. The framers real clearly stated that the enumeration in the constitution was not meant to be exhaustive. It was simply meant to be exemplary.
Not explicitly, no. But neither is the right to travel from New York to New Jersey. NYU law professor Kenji Yoshino explains our unenumerated rights.
