The Importance of Federal Administrative Agencies in India
The CBI and the National Investigation Agency are both federal administrative agencies. The Gavati High Court in 2013 said that the Constitution of CBI and DSP Act using executive notification was unconstitutional, but this judgment has been stayed by the Supreme Court. Chhattisgarh government has filed a petition before the Supreme Court challenging the constitutionality of NIA. Do you think it is a necessity which can be justified on certain other constitutional grounds or do you feel that there is enough in our constitution to justify having such an agency?
