There's an element of activism involved when judges are completely detached from a factual situation. Here they were thinking theoretically as to whether there should be a right to privacy under the constitution. And how did the Putaswami then feed back into the bigger hearing around Adhar? So what the Court said was, yes, there's a right to Privacy, but the state has a right or the state can infringe on it in certain circumstances.
