In 1938, during the Roosevelt administration, they passed a piece of legislation called the Fair Labor Standards Act. Truck drivers were explicitly exempted from being paid overtime and it's been like that ever since. The system here, because there's no cost associated with the driver's time, it creates what they call a market failure.
