Is the Hobbs Act a Crime of Violence?
The court has at times taken different approaches to assessing whether a criminal statute raises concerns because of the conduct that could be prosecuted. The question is whether a conviction under the hobbs act provision regarding robbery qualifies as a crime of violence. Some of the hypotheticals that the justices came up with about what might constitute an attempted robbery by threat under the hops act would not involve the use of force, or attempted use of force against a person.
