The federal government does not have the authority to do what lindsay graham wants to do. It's left to the states. Exactly as the supreme court said. Congress doesn't have plenary power to pass laws on everything it wants. Its actions must, too, have some basis in some part of the united states constitution. Article one spells out a long list of things congress can do. But the list, while long, isn't all embracing.
