The increased transaction fee increases the incentive for, let's call it an honest miner to pick up that transaction. And so then even though that malicious actor is trying to do empty blocks and block the network from proceeding, there are the honest miners who do want fees. The higher the transaction fees are going, the more they're inclined to include or anyone is inclined to try to include that transaction in a block.
