The Importance of Judiciary Power in Australia
In Australia, in the absence of a bill of rights, these issues are channeled through a lens of judicial power. It's channeled through chapter three of the Constitution. What a court can and cannot do. What is the nature of a court? Which is an interesting way to think about these issues. In most other jurisdictions with a bill of Rights, this would just be a rights case. Whereas here it's a judicial power case.
