The issue is both constitutional and statutory. Title VI of the Civil Rights Act of 1964 prohibits race discrimination in publicly funded education. The question then becomes, are there ways of achieving diversity without resorting to racial classifications? Because the racial classifications implicate the law in a way that discriminating on the basis of socio-economic status does not.
