Do You Think the Second Amendment in Heller Is Going to Have Staying Power?
John Avlon: The court doesn't tell us, at least not clearly, why those regulations are constitutional and not others. He says there's lotsof diffrent kinds of gun laws, and there's lots of diffrent approaches. Avlon: Even the current justice's holdings on the second amendment is still somewhat limited. And i can't imagine that a response to jackhammer might be to impose immeasurably higher level of judicial scrutiny onto these laws.
