There is a legislative component to legal interpretation, to adjudication. That's part of the nature of law. People who say you should be legislating from the bench have not thought about this. So I was thinking maybe to bat down our chief justices metaphor of, I just call the balls and strikes that that's actually to bat it down with another metaphor.
