The Role of Jurisprudence in Decision Making
I find Dorkin's in hard cases, he gets a little jargony and it doesn't read as well as the other critique that we read of his or doesn't read easily. But I guess I'm caught up in something about the notion of judgment. He's talking about how judges make decisions on the applicability of law based on extra legal considerations about intent for various things. And maybe I'm just caught up that I think his description sounds compelling and maybe it's not so much a refutation of hearts.
