The SEC's Strategy to Label Crypto Assets as Securities
Gensler's agenda is extremely ambitious. He's moving really quickly. There's a lot of enforcement actions that we've seen already. We could potentially see the SEC target these issuers individually. My personal opinion is that if the SEC had a strong enough case, we would have seen that. On the other hand, we're not seeing substantial policy from Congress and guidance from Congress to give the SEC or the CFTC further instruction on how to approach this asset class.
