The North Carolina Court of Appeals Strikes Down Partisan Gerrymandering
North Carolina court struck down partisan gerrymandering under the free and fair elections clause. John Avlon: The US Constitution does not have within it, and he's just initially manageable standards to judge whether a map is too political. He says states can use their lawmaking process or adopt redistricting independent institutions instead. Avlon: We said it is troubling and perhaps a violation of the US Constitution if the state court not having that clear statement coming from the people takes it apart itself in these big phrases.
