Nick Hackney's Conviction Was Nixed on an Appeal

Nick Hackney was sentenced to life in prison without the possibility for parole. The state Supreme Court sided with him on an appeal that nixed his mandatory life sentence, which then sent him back to court for resentencing. Nick's team argued that the jury was not properly instructed on the aggregate aggravating factor thing because Don was already dead since Nick had suffocated her. He was still convicted of murder, but because it wasn't technically aggravated murder, the life sentence was thrown out and he was res sentenced to 26 years in prison.
