As of now the case law favors the DOJ's reading of 1512, it has not been determined by the Supreme Court. The otherwise issue was front and center in a two to one DC circuit case that adopted the prosecution's reading of the otherwise clause as expanding dramatically the language of the statute. And I think there's very smart arguments on both sides, but I am still skeptical of the idea that you would have the really specific.
