The State in Capitalist Reproduction
Law must be formulated as a system of guarantees. Every individual must be certain that his or her rights will not be violated, thus preventing any individual from imposing on another. The state acquires new formal determinations as a general embodiment of the power of the bourgeoisie and must thereby assume new functions aimed at ensuring the global process of capitalist reproduction. Beyond its legal dimension as a rule of law, the state is also in a necessary and objective way the representation of the political power of the bourgeois class.
