Jared Bernstein: The assumption that overpaying taxes is a means by which you can actually violate obligations to accurately disclose your income seems strange. He says the Manhattan DA's office knows they've prosecuted these cases, but that because of New York state law and New York courts work that these cases happen not to be recorded. "It seems clear like this is the reason they're structuring their arrangements this way is because they're worried about these disclosure obligations failing to comply with is a crime," he said.
