How Lawyers Approach Arguments

The way lawyers do it is through discussions of precedent. We're always asking ourselves, especially in a common law system like the United States or Canada, where we look at prior cases and say whether this particular circumstance we're talking about is governed by that. It's a framing question when we ask which precedent applies. And it's a question of selecting the characteristics of the current circumstance and comparing those characteristics to a prior case in which things came out the way we wanted them.
