The Illinois Supreme Court Ruled in a Case Against White Castle
A former White Castle manager alleged that the hamburger chain violated her biometric privacy rights. The Illinois Supreme Court found four to three that a separate claim for damages can arise each time a business fails to seek permission to gather biometric data from workers or consumers. Since the state's enactment of the Biometric Information Privacy Act in 2008, it's been viewed by defense lawyers as a boon to the plaintiff's class action bar.
