There is no test case to ascertain whether being in the water itself constitutes trespass. The likelihood of a landowner taking you to civil court with trespass is almost negligible and would be a massive waste of their time and money if they did. So there's a long heritage to this phrase right to roam. And it comes absolutely out of working-class struggle, working-class resistance to them being shoved off land. There was a kind of charter for open air health benefits that was proposed when the National Health Service was first set up. But doctors are telling us, OK, where do I go?
