Modern people think of juries as primarily a way to defend the rights of the accused. Whitman argues that originally that test was designed to protect the consciences of the juries themselves. And effectively, if there were 12 of them and they were sure beyond reasonable doubt, that was enough. Their consciences could rest easy.
