The Politics of Popular Sovereignty in the US

There's quite a stark divide between certain intellectuals of the left in the US and mainstream liberal opinion which basically is that if you listen to certain I think even someone like our sometime contributor Ben Burgess is in this camp. Public intellectuals on the left tend to be highly critical of the power of the Supreme Court in the U.S. because they see it as a depoliticizing institution. In some cases they would argue abolished altogether in order for us to have an actually democratic country so there is kind of an interesting set of political questions here about popular sovereignty.
