Congress created the right to sue for violations of constitutional rights during Reconstruction. The Supreme Court quickly said, interpreted the statute and interpreted the Constitution in all sorts of ways that made it really difficult to sue. "The Supreme Court never came out and said, we support the Ku Klux Klan," he says.
