Brior's Deference to the Administrative State
Brior was one of the leading progressives, or democrats who was in favor of cost benefit analysis in reviewing regulations. He tended to do most of his work on hot button issues such as women's rights and voting rights. Brior thought he was much more moderate than his performance on the court. But i would be less worry about it if he were the administrator to whom he gave deference for because i never thought that, in terms of his day to day operation, that briar had sort of very polarized instincts on anything.
