Jack Goldsmith of law fair wrote an op-ed in the New York Times arguing that having two special counsels may make things more complicated. Ben Navarrette: I think there is actually a mechanism that potentially resolves this, which Jack does mention. He says both are required to write final reports and so one issue is who goes first? If Mr. Hurgoes first, then Mr. Smith will have to explain why his case is different from the one that Hur brought," Navarrette said.
