Mark O'Mara: One of my lawyer friends once said to me, I never actually have to prove that I'm right. And therefore, by default, I become right in the eyes of whomever is adjudicating the case. How does that feel when you hear that? Well, that's a question of the burden of proof. He says if you can destroy their argument, even if your argument isn't necessarily right, it makes it easier for you to make your case to your decision maker. "The biggest kind of mistake ... is failure to prepare sufficiently," he says.
