The Defense's Decision to Dismiss a Pending Case
Two days after the mistrial was declared, we got an email from the Department of Justice telling us that they intended to file a motion to dismiss against our client with prejudice. And between that order and the Assistant Attorney General coming to Denver, I think, realizes it needs to do something. It can't hold the line on all 10 defendants. So it dismisses against your client and five total defendants to leave five defendants for trial number three.
