i used to argue that the second condition was necessary. I no longer do and i've changed my mind some time ago. As long as you're the first mover, not only is that sufficient, but it's also necessary. And whether or not he could have done otherwise would be irrelevant. Because as as you establish that first condition, i would say, libertyr and free will is established.
