The counter argument that they can use at that point is if all they did was write the smart contract, right? Let's assume a way DNS and a front end for the smart contract and things like that. Then telling them they have to rewrite this code a certain way would be unconstitutional. And compelled speech is one of these things in the US that we think is unconstitutional. So you can make a credible argument that that would be unconstitutional to force that kind of speech.
