The question presented according to the court was whether to establish a true threat unprotected by the First Amendment, the government must show that the speaker subjectively knew or intended the threatening nature of the statement. Geewalt: A fire's position on that reasonable person standard is that speech that is at the margins of political or social acceptability might be punished as if it were a threat.
