The Procedural Constraints of the American Bureaucracy

A lot of progressives today believe that the courts are a legitimate substitute for legislative action. I think what we're seeing now is that conservatives can make use of the courts just as well as liberals can. In the end in our constitutional system, it's much better to have Congress make these decisions and delegate broad authorities.
