Archibald Cox was free because he'd just been fired as the special prosecutor Investigating president Nixon. He went up to this family farm in Maine and wrote a brief for Harvard on affirmative action. In an oral argument in 77, Lewis Powell who's from Virginia is looking for a kind of middle ground compromise. The five liberals want a remedy past exclusion and deal with current racism while other conservatives want to say no consider of race ever.
