Is There Still a Place for Judiciary Discipline?
I don't think judges should necessarily be bound entirely by what the risk assessment says, because i think there are going to be situations in which diversion in either direction makes sense. Even well constructed reforms depend very heavily on a human element. I do think that there is some subset of the incarcerated population that doesn't belong in jail or prison,. And i think they should be identified and released. But we should also try to identify the substance of the general population that should be, but isn't, behind bars.
