After the ballot referendum, freedmen descendants were once again excluded from the tribe. Maryland's lawsuit in federal court was still going on. Her legal team argued that the cherokee nation having a law excluding the descendants of freedmen from citizenship violated the 18 66 treaty. But the Cherokee nation argued that the wordg the treaty wasn't actually clear cut. It didn't explicitly say freedmen had the right to citizenship. The federal court ruled in favor of the freed people, maryland one. So in august 20 17, descendants of freed people were able to become citizens.
