The Role of Violence in Obstructing Congress
This is being hotly litigated in the DC circuit right now. The concept of what makes out obstruction of Congress is difficult because we're allowed to try to influence Congress. What the court is grappling with is how do you come up with a rubric of obstruction that doesn't capture a lot of constitutionally protected activity? I think we may still get clarification from the D.C. circuit about what they think obstruction means.
