The Importance of Courts in Public Policy

Political scientist says courts make policy while denying that they are making law. Changes in American government separation of powers, decentralization have made it difficult for the courts to be as involved in policy-making as a European parliamentary system. In 80s and 90s, liberal wing of legal establishment developed new theories of jurisprudence which allowed judges to say nothing more than interpreting federal statutes.
