Law is supposed to be a bottom up process of discovery even when you're talking about statutes. I'm pretty sure Hayek would have agreed with that to the extent, I don't think he was against all laws. There's a very Hayekian way of understanding how knowledge accumulates in a society. embedded knowledge is like this wildly important concept.
