Justice Gorsuch is famously a proud textualist. In cases involving statutory interpretation like Bostak, he joined the liberals in saying that the text of Title VII was clear and included sexual orientation and discrimination. Justice Barrett has written extensively this term to say that she thinks that history is extremely important but there are unanswered questions about what periods of history matter.
