The Legality of Encryption

We think it's legal, but we're not as certain as we would like to be. The argument against liability depends on some of the exceptions to wiretap activity. One of the nice things about this kind of encryption is that platforms don't retain any information once they do the processing. That means that they are not retaining the kinds of stored communications that could trigger the Stored Communications Act.
