The CS-D and the Environmental Side of the Directive
The CS-D is about getting companies to monitor and measure their negative impacts on human rights and the environment. The European Parliament has removed downstream relationships from the scope of the directive, so everything that happens after the product is made are no longer subject to due diligence requirements. It's not only a reporting requirement, such as the UK Modern Slavery Act, for example, but it mandates human rights due diligence,. There is civil liability for companies that fail to show that they have adequate due diligence programs.
